Affirms Federal High Court Judgement
In a significant ruling, the Rivers State High Court has dismissed a case against 25 lawmakers on the grounds of jurisdiction, stating that the claimants lacked the locus standi to
institute the suit. The judgment of the Federal High Court was also acknowledged as binding on this court.
Presiding Judge Hon. Justice Okogbule Gbasam affirmed that the suit was properly commenced by originating summons. Despite the procedural correctness, the case was
dismissed due to the lack of standing of the claimants.
Furthermore, the judge ruled that the 25 Members never lost their seats and everything they did are valid.
Hon. Justice Okogbule Gbasam of Degema High Court sitting in PH said his ruling was based on jurisdiction, in which could reled that they lack the locus standi to institute the case despite that the procedure adopted by the Claimants by way of Originating Motion which sought interpretation of the law was correct.
