In a Judgment of the Rivers State High Court delivered by Hon. Justice S.H Aprioku, the court has delivered a judgment in favour of Rt. Hon. Ehie Edison, Chief of Staff, Govt House on a Fundamental Rights suit filed against the Nigerian Police.
The matter, which pertained to the fundamental human rights of the applicant, was brought before the court for hearing and determination. Counsel for the applicant, D.O. Okoro, SAN, and C.M. Dickson, Esq., representing the respondents, presented their arguments before the court.
The judgement, delivered after careful consideration of the arguments presented, outlined several key points:
1. The dismissal of the preliminary objection raised on the issue of jurisdiction, deemed lacking in merit.
2. A declaration restraining the respondents from arresting the applicant based on charges alleged to be politically motivated and aimed at settling scores, specifically referencing the burning and destruction of the Rivers State House of Assembly chambers.
3. An injunction preventing the respondents from harassing, intimidating, or detaining the applicant in connection with the aforementioned charges, deemed a gross contravention of the applicant’s right to personal liberty.
4. The awarding of costs amounting to One Hundred Thousand Naira (₦100,000) in favor of the applicant against the respondents.
