The Nigerian Electricity Regulatory Commission (NERC) has issued an official order transferring regulatory oversight of Abia State’s electricity market to the Abia State Electricity Regulatory Authority (ASERA), in line with the amended Constitution and Electricity Act 2023.
This move follows the Abia State Government’s compliance with all legal requirements and formal request for the transfer, as mandated by the Electricity Act. NERC, while retaining authority over interstate and international electricity operations, will no longer oversee intrastate electricity matters within the state.
As part of the transition, NERC has directed the Enugu Electricity Distribution Company (EEDC) to incorporate a subsidiary—EEDC SubCo—within 60 days from June 25, 2025. This new entity will handle electricity supply and distribution within Abia and must secure a licence from ASERA.
All regulatory and operational transitions are expected to be finalized by December 24, 2025.
